CAMERON HOMES TO APEAL AGAINST PLANNING APPLICATION REFUSAL BOOTHS LANE

Cameron Homes were granted planning permission to develope part of the Booths Lane site. They then decided to request an amendment which would have meant them not having to put in a safety trench to help prevent gas leakage from the near by landfill site. This amendent was not accepted by the Birmingham City Planning committeel who refused their request for permission "not to install a tench" intended to stop gas getting onto their new development site. This decision was made on the grounds of safety. Cameron homes feel the trench is not needed and is expensive.
Given the Decision I am trying to get the council and Cameron Homes to work together to come up with an alternative solution which could be less expensive but still safe.

Appeal under Section 78
Appeal by: Cameron Homes Limited
Site: Land adjacent to Booths Lane, Great Barr, Birmingham, B42 2RG
Proposal: Removal of condition 17 (which requires a gas cut off trench or wall) attached to
previous planning approval 2011/01795/PA (which allowed a residential development of
43 dwellings).
An appeal has been made to the Department for Communities and Local Government (DCLG) against
Birmingham City Council's decision to refuse the above application.
An Inspector appointed by the DCLG will determine this appeal on the basis of an inquiry and the procedure to
be followed is set out in the Town and Country Planning Appeals (Determination by Inspectors) (Inquiries
Procedure) (England) Rules 2000.

and will be returned. Please send three copies of any written representations, quoting the DCLG reference above Please note the decision is now not in the hands of the Birmingham City Council planning Committee who rejected it.
They did however agree the original application.

Note it is expected as part of the planning requirements a section of the unadopted Booths Lane will be altered and relaid. This is a separate issue regarding safety requirements.
